CVDL attorneys teach litigation course for the MO Bar.

CVDL attorneys Tim Van Ronzelen and Kari Schulte recently taught “Representing Nursing Home Residents and their Families” at the request of the Missouri Bar.  The continuing legal education course was available to attorneys of the Missouri Bar and was well-attended.  Tim and Kari have represented a number of nursing home residents and their families in a variety of cases, including abuse, neglect, fall and death cases.  Kari’s portion of the presentation highlighted the proposed CMS rule that will, in general, allow nursing homes to require residents arbitrate their disputes instead of utilizing the court system.  She also discussed recent United States Supreme Court and Missouri Supreme Court cases on the topic of arbitration agreements.  Tim discussed key documents in nursing home litigation, including the resident’s Community Based Assessment, Individual Service Plan, Fall Risk Evaluation and Head Strike Log, and how to utilize those documents to the client’s benefit in litigation.
