CVDL’s client prevails in Missouri Supreme Court employment case

The Missouri Supreme Court ruled in favor of a CVDL client pursuing a discrimination claim alleging she was wrongly fired from her job when she required the use of her guide dog.  CVDL attorneys Tim Van Ronzelen and Shelly Kintzel represented the employee. The employer argued that the claim could not proceed in court  because the employee, though blind, had electronically “signed” an arbitration agreement at the time of hire.  The employee’s evidence demonstrated that the manager did not inform the employee that one of the documents was an arbitration agreement, and instead represented that the documents were routine. The Supreme Court, in a 4-3 decision, agreed with the employee that the trial court correctly determined that no valid arbitration agreement existed.

This decision clears the way for this case to go to trial in July 2020 on the discrimination allegations.
